RE:First Reading, Ordinance 2016-2087: Amendments to Fertilizer Application Ordinance

REQUEST:

The request of staff for City Council is to review and consider for approval the first reading of the attached ordinance amending the application of lawn fertilizers.

 



DISCUSSION
:

The City's current National Pollutant Discharge Elimination Permit (NPDES) requires the City to review, and amend its existing fertilizer application ordinance every Permit cycle of five years.  When performing the review and implementing the updates into the existing ordinance, staff typically will incorporate the Florida Department of Environmental Protection (FDEP) model ordinance.  The model ordinance is created by (FDEP) staff and includes all of the mandated requirements the City's (NPDES) permit calls out for the City's compliance.  Amendments included are as follows:

·       Section II. Line 1, 2, 3, Page 4, Definitions, Deletion of term and definition "Approved Test".

·       Section II. Line 22, 23, Page 4, Definitions, Addition of term and definition "Guaranteed Analysis".

·       Section II. Line 10, Page 5, Definitions, Deletion of existing non-native language and replace with exotic.

·       Section II. Line 15, Page 5, Definitions, Deletion of term and definition "Pasture".

·       Section VI. Line 6, 7, Page 8, Section VI. Insert Language, Prohibited Application Period of fertilizer, even in slow release formulations, during the summer rainy season typically June 1 to September 30.

·       Section IX. Line 18, 19, 20, 21,22, Page 9 Insert Language, Fertilizer containing nitrogen shall not be applied before seeding or sodding a site, and shall not be applied for the first 30 days after seeding or sodding, except when hydro-seeding for temporary or permanent erosion control in any emergency situation (wildfire, etc.), or in accordance with the Stormwater Pollution Prevention Plan for that site.

·       Section XIII. Line 9, Page 12, Insert six hour.

·       Section XIII. Line 14, Page 12, Add Private, Non-commercial.

·       Section XIV. Line 20, Page 12, Remove Prior to January 1, 2014, Insert All.

·      Section XIV. Line 10, Page 13, Remove After December 31, 2013, Insert All.

·       Section XV. Line 6, Page 14, Remove Section 125.69, Insert Chapter 162

·    Section XVI. Line 17,18,19, Page 14, Remove the Code Enforcement Officer, Insert a Special Magistrate, Code Enforcement Board, County Court or other City enforcement mechanism.

·       Section XVI. Line 22, 23, Page 14, Remove the Code Enforcement Officer, Insert a Special Magistrate, Code Enforcement Board, County Court or other City enforcement mechanism.

·     Section XVII. Line 11, 12, Page 15, Insert Special Magistrate, Code Enforcement Board, county Court or other City enforcement mechanism, Remove Special Master.

·     Section XVII.  Line 14, 15, Page 15, Insert Special Magistrate, Code Enforcement Board, County Court or other City enforcement mechanism, Remove Special Master.

·       Section XXI. Line 15, 18, Page 16, Add effective dates to correlate to with Council Session Approval date.

 



RECOMMENDATION:

Adoption of the amended ordinance first reading is recommended.

 



BUDGET/FISCAL IMPACT:

There is no impact on the budget.
