Staff requests City Council approval of the Ordinance amending Chapter 15.00.00, and subsuming Section 11-16 within Chapter 15.00.00.  Additionally, Sections 11-17 and 11-18 are to be stricken from the Code.

From time to time it becomes necessary to amend portions of the code to address various issues that the City faces and to increase efficiency.  In order to assist the City’s Code Enforcement Department it is necessary to merge the City’s Excessive growth and accumulations section contained in Section 11-16 with Chapter 15.00.00 of the code which addresses general storage, unsanitary conditions, and general public nuisance issues.  In sum, the amended Chapter as presented, provides for definitions, and clarification of nuisance activities. 

Pursuant to discussion at the City Council meeting on June 21, 2016, it was confirmed that Section 10-4 of the City Code already addresses disposal of yard debris and pickup.  In order to provide further clarification, a section was added to the proposed ordinance providing that the ordinance does not supersede Section 10-4 of the Code.  Also, the definition of debris was expanded to include vegetative matter.
