RE:First Reading, Ordinance #2016-2088: Public Notice Requirements

REQUEST:
Council is to conduct a first public hearing of the ordinance.

DISCUSSION:

The Land Development Code (LDC) contains outdated references with respect to public notices for rezoning and special exception cases.  Additionally, the Code requires that notices for City Council rezoning hearings include the Land Development Review Board (LDRB) recommendation. This often prohibits the ability to schedule the Council meeting immediately after the LDRB meeting.

 

This amendment will replace references to the former Planning and Zoning Commission with the LDRB and replace references to the Municipal Building with City Hall (and the correct address).  It will also remove the LDRB recommendation in the notice to City Council.

Compatibility with Comprehensive Plan:

The proposal is consistent with the following Comprehensive Plan objectives and policies:

 

  • FLU Objective 1.1 - Manage future growth and development through the implementation and enforcement of the Land Development Code in a manner consistent with the Comprehensive Plan and Future Land Use Map.

 

  • FLU Policy 1.1.2 - To implement this Comprehensive Plan, the City shall continue to implement land development regulations that contain specific and detailed provisions…


RECOMMENDATION:
Staff recommends approval of the ordinance. The Land Development Review Board recommended approval at its June 23, 2016 meeting.
