RE:Non Emergency Resolution #2016-18 - Abatement and Removal of Unsafe Structure at 5052 Tangelo Drive

REQUEST:

This non-emergency resolution is scheduled for the October 4, 2016 City Council meeting.  The structure has been determined to be unfit and unsafe due to damage from a fire.  The purpose of the meeting is to report the condition of the structure to City Council which may, by resolution, declare the structure to be a nuisance and necessitate appropriate action.  The matter shall be handled as a quasi-judicial proceeding.



DISCUSSION
:

The subject property is 0.15 acres located on the east side of Tangelo Drive approximately 325 feet north of Tangerine Drive in the Jasmine Heights subdivision (Exhibit “A”, Site Location Map).  The site contains a damaged single-family dwelling.  It has been owned by Philip V. Casatelli, Jr. and Elizabeth B. Casatelli since March, 2012. 

The structure was damaged by a fire on June 30, 2016.  It was inspected by the Building Official that same day and by the Building Inspector on July 1, 2016.  The Building Official determined that the structure meets the definition of unfit or unsafe structure and shall be abated under non-emergency condemnation procedure (see Exhibit “B”, Article VI of Code and Exhibit “C”, Site Photographs).  Notice was sent by certified mail to the owner and interested parties on September 2, 2016.  It was posted on the property on July 1, 2016 (see Exhibit “D”, Notice of Condemnation Posted on Property).  It was also placed in the Tampa Bay Times on September 2, 2016 and September 9, 2016. 

City Council shall hear evidence pertaining to whether the structure is unfit or unsafe, including any testimony or evidence which the owner of the property or any interested person may desire to tender. Upon a proper showing and considering of all the evidence, City Council may, by resolution, declare the structure to be a nuisance and authorize the Building Official to take appropriate, specific action at a time certain but in no case sooner than 16 days from the date of such resolution. Staff is recommending removal of the structure as early as October 24, 2016.  If the owner or any interested person can make arrangements for the abatement of the nuisance within the same time period as contemplated by City Council, the resolution shall be adopted but shall be held in abeyance for a stated time in order to allow the owner or such interested person, forthwith, to proceed with the abatement and removal of the nuisance; provided, however, that if the owner or any interested person does not proceed with the abatement in such manner, the nuisance shall be abated and removed in accordance with the provisions of the resolution.



RECOMMENDATION:

Staff recommends approval of the resolution.



BUDGET/FISCAL IMPACT:

If the City is to remove the structure from the property, the estimated impact to the budget is approximately   $6,000.  Costs incurred to date include certified mailings, advertising, and title search.   A separate hearing will be scheduled to assess the actual costs of abatement and determine if a lien should be imposed.
