RE:Second Reading, Ordinance #2016-2091 Relating to Noise

REQUEST:

This request is for Council to conduct a second reading for Ordinance No. 2016-2091 relating to preventing excessive noise throughout the City.



DISCUSSION
:

The police department routinely responds to citizens’ calls to address noise complaints. However, the City’s noise ordinance, as it is currently written, requires subjective judgement by the responding officer because it does not contain measurable sound level thresholds. It is nearly impossible to enforce.

This proposed noise ordinance provides specific permitted sound decibel levels that can be measured with a decimeter, thereby removing officer subjectivity. It also provides time frames for both residential and non-residential properties.



RECOMMENDATION:

I recommend approval of the proposed noise ordinance as submitted.



BUDGET/FISCAL IMPACT:

The Department has an inventory of decimeters available for distribution to all patrol supervisors and field training officers; therefore, there will be no additional cost.
