REQUEST:
The request is for City Council to approve the appointment of Ms. Barrie Buenaventura to serve as the City's alternate Special Magistrate.
DISCUSSION:
As you are aware, Brent Simon, Esq., serves as the City's Special Magistrate. Due to the increase in cases coming before our Special Magistrate, staff feels that it is necessary to secure an alternate Special Magistrate to help process the caseload and/or in case there is a conflict of interest between Mr. Simon and a defendant. On August 30, 2016 a Request for Qualifications (RFQ) was let for alternate Special Magistrate services. Two proposals were received by staff in response to the RFQ; one from Ms. Barrie Buenaventura and one from Mr. Christian Waugh. Both candidates were interviewed for the position on November 21, 2016. After the interviews, it was clear that Ms. Buenaventura was an ideal candidate for this position. If approved by Council, Ms. Buenaventura will only serve when necessary with a fee for services billed at $125/hour.
RECOMMENDATION:
Staff recommends that City Council approve the appointment of Ms. Barrie Buenaventura to serve as the City's alternate Special Magistrate.
BUDGET/FISCAL IMPACT:
Funding for this item, if needed, is available in the City Council's budget line item for attorney services account number 001-0011-519-31-11. | | | |
