REQUEST:
The request of staff for Council is for the review and approval of the attached Utility Service Agreement between the City and Elaine Depardieu (Developer), for the existing developed site known as the Larson Plaza.
DISCUSSION:
The existing developed site consist of multiple commercial business’s operating out of one large building structure. The site is located at 7712 Massachusetts Ave. east of Rowan Road, outside the City’s corporate limits but inside the City’s utility service area. The location is depicted in the agreement as Exhibit A. The execution of the utility service agreement is due to the sites existing septic tank system failure. As a result of the septic system failure, the Developer has requested the City provide sewer service to the site. The agreement requires the Developer to construct the utility system in accordance with the City’s Utility Standards prior to the City’s acceptance of ownership. The Developer shall bear all costs associated with connecting into the City's existing sewer utility system.
RECOMMENDATION:
Approval of the Utility Service Agreement is recommended.
BUDGET/FISCAL IMPACT:
There is no budget impact.
