REQUEST:
Staff requests that the City Council review the request to amend the FY2018 Comprehensive Fee Schedule to add permit fees for Communications Facilities in Public Rights-of-Way and a permit fee for Donation Bins.
DISCUSSION:
On December 17, 2017, the City Council adopted Ordinance No. 2017-2129, which provided regulation over Communications Facilities in Public Rights-of-Way. The Ordinance also established an annual permit fee “in the amount of $500 per linear mile, or portion thereof, or the maximum amount allowed under Section 337.401(6)(b), Florida Statutes, whichever is higher”. Additionally, the Ordinance also established an annual permit fee for those who file an Application to Collocate Small Wireless Facilities on City Utility Poles in the amount of $150 per pole per year per Facility.
Ordinance No. 2018-2133 will be proposed to the City Council for adoption on February 20, 2018 (tonight’s meeting). If adopted, this Ordinance will regulate the use of Donation Bins throughout the City of New Port Richey and establish an annual permit fee in the amount of $50 per Donation Bin.
RECOMMENDATION:
It is recommended that the City Council adopt Resolution No. 2018-03, Amendment of the FY2018 Comprehensive Fee Schedule, which adds annual permit fees for Communications Facilities in Public Rights-of-Way and an annual permit fee for Donation Bins. In the event that Ordinance No. 2018-2133 is not adopted, then the recommendation will be to adopt Resolution No. 2018-03 to establish permit fees for Communications Facilities in Public Rights-of-Way only.
BUDGET/FISCAL IMPACT:
At this time, there is no budget or fiscal impact, as staff does not anticipate an immediate increase in revenue from the establishment of these fees. However, if a significant increase in revenue occurs during FY2018, the FY2018 Operating Budget will be amended, accordingly. | | | |
