RE:Resolution No. 2018-06 - Imposing & Assessing Cost of Abatement and Removal of Unsafe Structure at 6821 Garden Drive

REQUEST:
City Council is to conduct a hearing for the purpose of assessing the costs of abatement of the unsafe structure and determine if a lien should be imposed.  The matter shall be handled as a quasi-judicial proceeding.


DISCUSSION
:

The subject property is 0.07 acres located on the west side of Garden Drive, approximately 175 feet north of  Manor Beach Road.  It is located within the Edgewater Gardens Subdivision that was platted in 1959.  It is owned by Ronald Howarth.

City Council adopted Emergency Resolution No. 2017-12 on March 21, 2017, determining that the fire-damaged mobile home met the definition of unfit or unsafe structure and authorized abatement and removal of the structure under condemnation procedures.  It was demolished by the property owner in March, 2017, but the foundation of the mobile was not removed. He appealed the City's decision and the Court found in favor of the City. The City had the foundation removed on February 8, 2018.

The property owner was notified of the meeting via certified mail.




RECOMMENDATION:

Staff recommends approval of the resolution and authorization to impose a lien to recover costs outlined herein.


BUDGET/FISCAL IMPACT:

Costs incurred to date include certified mailings, advertising, title searches and demolition totaling $3,490.85.
