Mr. Patrick Moccaldi purchased the above referenced property on February 9, 2018. The purpose of the purchase was to accommodate the establishment of a boat lift and dock for his private use.
The reason that this matter is being presented to you is due to the fact that City regulations only allow for boat docks in a residential district as an accessory use to residential buildings. In this case, much like most of the property located on the east side of the Pithlachascotee River the parcel in and of itself is not large enough to provide for the development of any permitted use in the zoning district.
After careful consideration of the facts involved I have determined that it is not appropriate to deny Mr. Moccaldi the use of his property. Therefore, I have asked Mr. Driscoll to prepare a land use agreement which establishes suitable protections for the city related to the intended use. The agreement also permits Mr. Moccaldi to go forward with his plans for the property subject to the limitations as set forth by the city. The agreement is attached for your review.
