RE:Resolution No. 2019-03: Waiver and Refund of Garbage Dumpster Enclosure Permits

REQUEST:
This resolution is at the request of the City Council, which requested that a resolution be brought back to Council for a refund of previous fee payments and a waiver of future payments for compliance with the new dumpster enclosure ordinance.


DISCUSSION
:

On September 4, 2018, the City Council adopted Ordinance 2018-2144, which requires dumpsters to be fenced and gated. At the February 5, 2019 City Council requested that staff prepare a resolution to waive fees and refund already paid fees for dumpster fence permits.

 

This resolution entitles all those that paid fees may apply for a refund within 30 days of approval of this resolution from the Community Redevelopment Authority (CRA), and a waiver of fees for those that apply for a permit within 90 days of the approval of this resolution.

 

The Board of the CRA will have to approve the payment of the previously paid dumpster fees with CRA funds.



RECOMMENDATION:

Staff recommends approval of this resolution.

BUDGET/FISCAL IMPACT:

As off January 18, 2019, almost $2,000 in fees have been paid in permits for the dumpster fences and gates.
