RE:First Reading, Ordinance No. 2019-2155: Conditional Use for 5780 Main Street

REQUEST:
The request is for City Council is to conduct a first public hearing of the proposed ordinance for a conditional use permit at 5780 Main Street.


DISCUSSION
:

The applicant has requested a conditional use to rent and sell scooters and one-wheels in the Downtown Zoning District. As part of their proposal, they have indicated that they would like to provide guided tours on the vehicles. Because this is an operation that is not specifically listed  in the code as an eligible use, the applicant must apply to the City Council for a conditional use.

 

The proposal is to co-locate this business with Get Outside at 5780 Main Street. The company will have one full time and one part time employee, and operate from 10:00 AM - 10:00 PM Friday and Saturday, and 10:00 AM - 8:00 PM Sunday.

 

 

Since this type of retail establishment is neither an approved nor a prohibited use in the Downtown Zoning District, Section 7.11.02 of the Land Development Code, states, that the "City Council may approve such use upon a finding that the proposed use would contribute to the revitalization of the Downtown District, that the use would not be incompatible with the district's character and that the proposed use is compatible with other uses allowable by right in the district."

 

The Development Review Committee looked at all of three uses (sales, rental and tours) that the applicant wanted to locate on the property. Each were evaluated for downtown compatibility with existing conditions and future plans.

 

 



RECOMMENDATION:

The Development Review Committee (DRC) is recommending against the rental of electric scooters and one-wheels, test drives, and the organized tours, but recommends the approval of sales as proposed by the applicant.

 

The DRC felt the rental and tours does not meet the requirements as set forth in the Land Development Code for approval of a  conditional use. Because of the heavy use of vehicles on  Main Street and Grand Boulevard, and the large pedestrian population on the sidewalks and side streets of the downtown area, the DRC felt that the rental uses and tours were not compatible with other uses compatible in the district because of safety reasons.

 

A retail sales operation, however, would enhance the downtown. Even if they are used in the downtown area, their operators would become skilled enough to manage pedestrian and vehicle flows.
