REQUEST:
The request is for City Council to authorize the City Manager to enter into an agreement with Timothy P. Driscoll, Esq. to provide the services of City Attorney with an effective date of September 6, 2019.
DISCUSSION:
On September 6, 2016 the City Council entered into an agreement with Timothy P. Driscoll, Esq. to serve as the city attorney. The Agreement was for a one (1) year term and included an option for the City Council to approve up to two (2) one year terms. The term of that agreement is due to lapse and as a result and to continue his service to the city the request is to enter into a second amendment to the agreement. If this item is approved the term of the agreement is for one (1) year with an effective date of September 6, 2019.
Mr. Driscoll has handled the city’s business very professionally and with great distinction. It is therefore recommended that you consider this agenda item favorably. Incidentally, Mr. Driscoll is not requesting a wage increase and therefore all provisions outlined in the original agreement will remain the same.
RECOMMENDATION:
The recommendation is for the City Council to approve the Second Amendment to the Agreement which provides for a term of one (1) year and allows the City an option of authorizing up to two (2) additional one year terms.
BUDGET/FISCAL IMPACT:
The funding to support this request is provided for in the FY 2018-2019 and 2019-2020 Budgets.
