RE:First Reading, Ordinance No. 2019-2170: Rezoning of 5406 Cotee Rive Drive from R-1 Residential District to R-2 Residential District

REQUEST:
The request is for City Council to conduct a first reading of Ordinance No. 2019-2170,  to consider the rezoning 5406 Cotee River Drive.


DISCUSSION
:

Existing Conditions:

The 0.30 acre property is a corner lot, located on the west side of Cotee River Drive, and the north side of Lark Lane. Two R-1 properties adjoin to the north and the west. The lot is .30 acres in area.

 

The primary structure (1,022 square feet) is 29.2 feet from the front setback, 11.6 feet from the north side setback, 38.5 feet from the south side setback and 51.6 feet from the south setback. All of these are at the shortest point, because the lot is not rectangular, but curvilinear.

 

Proposal:

The applicant would like to divide the property into two parcels. The existing structure would remain, and a new structure would be built on the new parcel. The R-1 Zoning District requires a minimum lot size of 7,500 square feet. The existing lot size is 13,068, so that is not allowed under the existing zoning. However, the R-2 Zoning District requires only 5,000 square feet, so that is why a rezoning is requested.

 

All of the adjoining properties, and the properties that are across the street, have R-1 Zoning. Even though 2 parcels away, the properties have Highway Commercial Zoning away (87 feet), and 4 parcels away, the properties have R-3 Zoning (162.3 feet), changing the zoning of this parcel may be considered “spot” zoning, which, while it may be not illegal, it is not considered good planning process.

 



RECOMMENDATION:

The Land Development Review Board at their meeting on September 19, 2019 voted against the proposed rezoning. In large part, feeling that a smaller lot was inconsistent with the neighborhood characteristics.
