In spite of the use of multiple methods of collection i.e. - letters, collection agency action, liens and foreclosure the city has had limited success in its efforts to collect on delinquent code enforcement infractions. As a result, at this point it is appropriate to escalate the city’s efforts and determine an alternative means of collection.
In that regard, the Florida Statutes provide cities with the authority to impose a non-ad valorem assessment for fees which are not based upon millage and which can become a lien against a homestead.
In respect to the delinquencies for payment of code enforcement infractions it is believed that the uniform collection method will be a more effective means by which to enforce payment rather than the more traditional method of the lien foreclosure methodology and therefore it is recommended to you for your consideration.
In addition to the improved collection rate to the city it is also believed that a more effective means of collection will lend itself to a more heightened sensitivity to the appropriate level of stewardship for property in the city.
In order to go forward with the use of the uniform method of collection the City Council is being asked to support a resolution which affirms the city’s intent to collect code enforcement fines using this method.
Incidentally, if this item is approved by the City Council one final collection attempt will be made prior to certifying the assessment roll to the property appraiser for placement of the amount of the fine on the tax bills.
Also by the way, the collection period associated with the requested action includes all code enforcement fines assessed during the past 3.5 years and the total amount owed is $1,205,668.50.
