RE:First Reading, Ordinance No. 2020-2176: Future Land Use Map Amendment for 5432 Acorn Street

REQUEST:
The request is for the City Council to hold a first reading of an Ordinance for a Small-Scale Future Land Use Map (FLUM) amendment to change the land use designation of an 0.277 acre parcel located at 5432 Acorn Street from Low Density Residential (LDR-5) to Downtown.


DISCUSSION
:
The proposed FLUM amendment was reviewed for consistency against the Goals, Objectives, and Policies in the Comprehensive Plan. At the duly noticed September 26, 2019 Development Review Committee (DRC) public meeting, the DRC recommended the FLUM amendment be denied because it was inconsistent with Future Land Use Element (FLUE)Policy 1.3.3, which provides in part "Commercial land uses shall be located in a manner which ensure the compatibility with the type and scale of surrounding land uses...."  and FLUE Policy  1.2.4, which provides "Existing residential areas shall be protected from the encroachment of incompatible activities …."  The proposed FLUM amendment was found to allow the encroachment of a commercial land use into an existing residential area.  At the duly noticed December 19, 2019 Land Development Review Board (LDRB) public hearing, the LDRB affirmed the DRC's recommendation of denial.

RECOMMENDATION:

The recommendation is to deny the Ordinance as submitted.



BUDGET/FISCAL IMPACT:

There is no funding required for this item and it has no fiscal impact.
