REQUEST: The agenda request is for the City Council to conduct a first reading of Ordinance No. 2020-2182 which amends the Land Development Code, Chapter 5, Rezonings, Variances, Special Exceptions.
DISCUSSION:
Although the Land Development Code has guidelines for granting variances and special exceptions, it contains no guidelines for granting Official Zoning District Map amendments (i.e., rezonings) or Land Development Code amendments. This Ordinance addresses those omissions by establishing guidelines and repeals an inappropriately codified paragraph.
RECOMMENDATION: The Development Department recommends City Council conduct the first reading of Ordinance No. 2020-2182, which amends Land Development Code Chapter 5 as requested.
BUDGET/FISCAL IMPACT: The proposed Ordinance has a positive fiscal impact because it helps avoid potentially expensive lawsuits caused by taking arbitrary and capricious actions on rezoning applications and LDC amendments. | | | |
