RE:First Reading, Ordinance No. 2020-2197: Vacation of the Right-of-Way (Alley) Running between Franklin Street and Grand Boulevard

REQUEST:

The request is to vacate the City’s interest in the alley spanning on the south side of Wyoming Street and the north side of Tennessee Street between Franklin Street and Grand Boulevard and that the land heretofore occupied by said alley shall as provided by law revert to the owners of the abutting property with an easement for overhead utility lines.



DISCUSSION
:

The request related to this alley vacation was submitted by Mrs. Sonia Magruder who is the owner along with her husband of a parcel of property situated along the alley as referenced above.  This request is prompted by the fact that the Magruder’s are selling their home at 5845 Grand Boulevard.  In preparation of the closing a title report was obtained which indicated that the alley which is believed to be vacated was in fact acted upon by the City Council but not properly effectuated.

 

Based on some research it appears that the alley vacation was approved by the City Council in November of 1940 the evidence though of its subsequent recording is much less definite. Therefore, in order to address this matter the course of action being recommended is to vacate the alley and in so doing abandon the city’s interest.

 

Incidentally, there are 8 other property owners that are affected by this agenda item and they have all been noticed as to the proposed course of action.



RECOMMENDATION:

The recommendation is to approve Ordinance No. 2020-2197 with an easement for overhead utilities in regard to the vacation of Block 156 of the revised plat for the Town of New Port Richey as shown on the plat recorded in Plat Book 4, page 49 of the public records of Pasco County.



BUDGET/FISCAL IMPACT:

No funding is required for this item.
