RE:Second Reading, Ordinance No. 2020-2190: Amendments to Chapter 13 LDC RE: Vehicle Signs

REQUEST:

The request is for City Council to conduct a second and final reading of Ordinance No. 2020-2190 which amends Chapter 13 of the Land Development Code regarding vehicle signs.



DISCUSSION
:

The Land Development Code's definition of "vehicle sign" is vague and difficult to enforce.  To remedy the situation, the Ordinance  amends the definition of vehicle sign by adding eight (8) characteristics that create a rebuttable presumption that sign is an illegal vehicle sign. The characteristics are as follows:

 

  • Unregistered, or inoperable upon the public streets due to any defect therein or by reason of anything placed on or in the vehicle that would render it functionally or legally inoperable, including any obstruction of the windshield, or front passenger or driver side windows
  • Located within 35 feet of the nearest public right-of-way
  • Located substantially perpendicular to the nearest public right-of-way
  • Located in substantially the same location on the premises on two (2) occasions at least seven (7) days apart in any ninety (90) day period
  • The only vehicle of its size and type located on the premises
  • Not the size and type of vehicle regularly and customarily associated with and used in the business operated from the premises upon which the vehicle is located
  • Located on any premises in any area not designed and constructed for the parking of vehicles
  • Altered by the addition of any sign other by application of paint directly on the vehicle or a vehicle wrap designed and installed for advertising purposes

 

The Land Development Review Board approved the ordinance as submitted at their meeting on June 4, 2020.



RECOMMENDATION:

Staff recommends that City Council conduct the second and final reading of Ordinance No. 2020-2190 which amends Chapter 13 of the Land Development Code regarding vehicle signs as submitted.
