On January 21, 2020, City Council adopted Ordinance No. 2020-2177 granting approval of a conditional use for a scooter and one-wheel vehicle sales retail and rental store, known as “eCarve LLC”, located at 5707 Main Street. The six conditions included in the ordinance were:
1. No vehicles shall be rented or let to minors unaccompanied by an adult;
2. No test drives or training on vehicles shall be conducted or allowed on Main Street or the public right-of-way or sidewalk on Main Street;
3. No test drives or training on vehicles shall be conducted in any City property, unless and until approved by the City Manager and the applicant has fully executed an indemnity agreement approved by the City manager and provided proof of general liability insurance in the amount of no less than one million dollars ($1,000,000), naming the City as an additional insured, which insurance shall be maintained at all times as a condition of said approval;
4. Property liability insurance shall be maintained on rental vehicles;
5. All vehicles shall be returned to the business between one (1) hour before sunrise and one (1) hour after sunset each day; and
6. All rentals of vehicles shall be made between one (1) hour before sunrise and one (1) hour after sunset each day.
On January 5, 2021, the City received an application from eCarve, LLC to amend the conditional use regarding the hours of operation. The change requested is to extend the hours until 9:00 p.m. on Wednesday, Thursday and Sunday and to 11:00 p.m. on Friday and Saturday.
On January 14, 2021, the Development Review Committee (DRC) reviewed the request and did not support the extension of the operating hours to 11:00 p.m. on Friday and Saturday due to safety concerns. During the DRC discussion the applicant agreed to revise the request from 11:00 p.m. on Friday and Saturday to 9:00 p.m. The DRC recommended approval of the 9:00 p.m. time.
The proposed Ordinance No. 2021-2226 revises the hours of operation approved under Ordinance No. 2020-2177 as follows:
- All vehicles shall be returned to the business between one (1) hour before sunrise and 9:00 p.m. each day; and
- All rentals of vehicles shall be made between one (1) hour before sunrise and 9:00 p.m. each day.
The proposed hours of operation within Ordinance No. 2021-2226 are consistent with the DRC recommendation to limit the hours to no later than 9:00 p.m.
No other conditions from the original approval of Ordinance No. 2020-2177 are changed.
