RE:First Reading, Ordinance No. 2021-2235: Rezoning for 6009 Main Street

REQUEST:

The request is for City Council to conduct a first reading of an ordinance to consider a rezoning at 6009 Main Street from R-3 within the Downtown Residential Overlay District to Downtown.



DISCUSSION
:

The City received an application for a rezoning of a 5,000 square foot parcel located at the northeast corner of Main Street and Madison Street.  A single-family home is currently on the subject property. The subject property has a Downtown future land use classification and is zoned R-3 within the Downtown Residential Overlay District (DROD).  The rezoning request is to change the zoning from R-3 within the DROD to the Downtown zoning district.  A full analysis of the rezoning request is provided in the attached City staff report.

In summary, the City staff report finds that the rezoning of the property to Downtown would bring the potential for more intensive uses into the eastern portion of Downtown, which is primarily comprised of properties with R-3 zoning classifications.  Generally, Madison Street provides a break between the more intensive Downtown zoning district properties to the west of Madison Street and the R-3 zoning district properties to the east of Madison Street.  Also, the subject’s property current inclusion within the DROD provides the opportunity for low-impact retail and professional offices subject to standards of the DROD.

 

Public notice for the proposed conditional use was provided as required by the Land Development Code.  As of August 26, 2021, one response to the noticing was received by the City in opposition to the rezoning.  The response in opposition to the rezoning is included in the attached staff report.



RECOMMENDATION:

The City’s Development Review Committee (DRC) reviewed the proposed conditional use at their July 29, 2021, meeting.  The DRC recommends denial of the rezoning based on the analysis provide in the attached City staff report.

The City’s Land Development Review Board (LDRB) held a public hearing for this rezoning on August 19, 2021. Based on the information provided in the City staff report and testimony provided at the public hearing, the LDRB recommends denial of the rezoning.
