RE:Second Reading, Ordinance No. 2022-2258: Animal-Drawn Vehicle Ordinance

REQUEST:

The request before the City council is to conduct a second and final reading of an ordinance regarding animal-drawn vehicles.



DISCUSSION:

As Council is aware, this item was presented for first reading at your regular meeting on April 5, 2022. After an in-depth discussion City Council requested that several changes be made to the ordinance before second reading. The substantial proposed changes included:

 

  • Change in franchise fee amount from 2.5% of gross receipts to 1%
  • Areas of legal operation
  • Reasonable rest time for the animals
  • Deletion of lighting and SMV emblems provisions

 

The City Attorney has incorporated all of the requested changes into the updated attached proposed ordinance.  For your convenience, a strikethrough version has also been attached which outlines all of the changes made to the ordinance from the first reading.

 



RECOMMENDATION:

Staff recommends that City Council conduct the second and final reading of an ordinance regarding animal-drawn vehicles as submitted.



BUDGET/FISCAL IMPACT:

There is no fiscal impact associated with this item as the franchise fees collected will provide a revenue source to the City's General Fund.
