REQUEST:
The request is to grant an easement of public property on property adjacent to the property at 6220 Grand Boulevard to Grand Missouri, LLC in relationship to the proposed reuse of the former Dulcet Restaurant.
DISCUSSION:
The owners of the former Dulcet Restaurant property have indicated an interest in having the right to use city owned property to support the operation of the businesses that they plan to house in the building i.e- emergency egress, cleaning equipment, refuse containers and mechanical facilities. In that regard, I am recommending a non-exclusive access easement for use in conjunction with their property.
The easement is intended to run with the land and will terminate if the building is razed or the property is substantially redeveloped so that the required setbacks for the property have been met. As a condition of their use of the property the city will be listed as additional insured on the businesses liability insurance in the amount of One Million Dollars ($1,000,000.00) per occurrence.
RECOMMENDATION:
The recommendation is to authorize the City Manager to enter into an access easement agreement with Missouri Grand, LLC related to the use of city property to support the operation of a restaurant and a business use in the former Dulcet Restaurant.
