REQUEST:
Staff requests City Council approval of the Ordinance amending Chapter 5, Sec. 5-44(5)(b) regarding elimination of the insurance requirement for private docks attached to public property.
DISCUSSION:
From time to time it becomes necessary to amend portions of the code to address various issues that the City faces. It was recently brought to staff’s attention citizens were having a difficult time securing the necessary insurance under the current requirements of the Ordinance. Insurance companies were unwilling to issue policies to the property owners naming the City as an additional insured. The Ordinance as it currently stands requires the property owner to execute a license agreement which includes an indemnification clause.
RECOMMENDATION:
Staff recommends approval of the proposed Ordinance relative to amending Sec. 5-44(5)(b) regarding elimination of the insurance requirement for private docks attached to public property.
BUDGET/FISCAL IMPACT:
