REQUEST:

The request before the City Council is to consider the attached ordinance that will allow the opportunity for private property owners to transfer unused developed rights on their land to the City with the further approval of the City Council.



DISCUSSION
:

The City’s TDR program limits the transfer of development rights from City owned land in the Coastal High Hazard Area (CHHA) to other properties in the CHHA.

 

The proposed ordinance expands the program to allow for private property owners in the CHHA the opportunity to transfer their development rights to the City and for the Council to approve a transfer of development rights to other properties throughout the entire City.

 

This proposed ordinance will allow the Council to protect environmentally sensitive areas while managing growth in an orderly manner.

 

Additionally, the proposed ordinance eliminates the need for a conditional use permit and incorporates the TDR into a Planned Development District rezoning.



RECOMMENDATION:

The Land Development Review Board reviewed the ordinance and recommends that the City Council approve the ordinance.



BUDGET/FISCAL IMPACT:

No immediate fiscal impact to the City however may generate revenue depending on the TDR Credits that are acquired from the ordinance changes.
