REQUEST:
The request of staff for Council is to approve Resolution No. 2023-07 impact fee credits between the City and Lennar Homes, LLC, a Florida limited liability company known as the developer and the impact free credit agreement.
DISCUSSION:
The proposed development site consists of the construction of 287 single-family homes and 44 townhomes for a total of 331 units. The development site is approximately 120 acres and is located east of Osteen Road and approximately 635’ south of Massachusetts Avenue in unincorporated Pasco County outside the City’s corporate limits but within the City’s utility service area. Should City Council approve the resolution, it would grant the City Manager the authority to enter into an impact fee credit agreement with the Developer. The proposed agreement has been attached for City Council's reference. Subsequent to the agreement’s execution of signatures, the Developer will be allowed to tie into the City’s existing reclaimed water system located on Massachusetts Ave. just west of Osteen Road and to extend the reclaim system south along Osteen Road into the proposed development. The Developer will be required to construct the reclaimed system extension in accordance with the City’s Utility Standards prior to the City’s acceptance of ownership and the City re-imbursing the Developer for engineering and construction costs utilizing the impact fee credit process authorized under Florida State Statute Section 163.31801.
RECOMMENDATION: Approval of Resolution No. 2023-07 and the attached impact fee credit agreement are recommended.
BUDGET/FISCAL IMPACT:
Impact fees collected will be considered utility revenue dollars.
