RE:Appeal of Variance #2023-03: Reduction in Required Parking at 5308 Lemon Street

REQUEST:

The applicant is proposing a restaurant/music venue at 5308 Lemon Street in an existing 1,192 square foot building.  This use requires 11 parking spaces (1 space/100 sf of floor area). 

 

The applicant has submitted a concept plan that includes eight (8) parking spaces.  Only six (6) of those spaces meet code as two (2) are stacked in front of other proposed spaces and one (1) of those stacked spaces does not meet the required size for a parking space.

DISCUSSION
:

The Development Review Committee (DRC) recommended denial of the application after review and discussion of the matter with the applicant as the request did not meet the merits of a hardship as defined by the LDC. 

 

The Land Development Review Board (LDRB) recommended unanimous approval of the request citing the merits of the business and the desire for continued economic development in the City.



RECOMMENDATION:

As per the LDC, if the LDRB disagrees with the recommendation of the DRC on whether to approve or deny a variance, then the petition shall be considered by the City Council in the form of an appeal.

 

 



BUDGET/FISCAL IMPACT:

There is no direct fiscal impact on the City however viable economic development does increase the overall tax base.
