The request is to approve Amendment Number 3 with Kimley-Horn and Associates, Inc. for an amount not to exceed $25,000 in relationship to the Sims Park Improvement Project.

As you are aware, there have been additional professional services provided by Kimley-Horn and Associates, Inc. in the course of the implementation of the Sims Park Improvement Project. The majority of the additional work results from field changes initiated by the City in order to improve the project. A complete account of the specific tasks covered by this contract amendment is attached for your review. 

As you can see from the attachment, the fee being requested to cover the services is $44,700. From staffs perspective there were numerous concerns about the proposed fees that warranted review and discussion. Therefore, several discussions took place between staff and Kimley-Horn in regard to resolving this matter and at the conclusion of which they agreed to accept a fee in the amount of $25,000 for the services performed.

In my opinion, the revised fee being requested by Kimley-Horn covers work that was performed outside of the scope of their original contract and the amount is fair.
